Heard the parties.
The petitioner has been made accused in connection with Balumath P.S. Case No. 71 of 2021, S.T. Case No.168 of 2021, for the offence registered under Sections 147, 148, 149, 307, 120B of the Indian Penal Code, Sections 25(1-A), 25(1-B)(i), 26(2), 27, 35 of the Arms Act and Section 17 of the C.L.A Act and charge framed under Sections 147, 148, 149, 307, 120B of the Indian Penal Code, Sections 25 (1-A), 25(1-B)(A), 26(2), 27, 35 of the Arms Act and Section 17 of the CLA Act, pending in the court of learned Additional Sessions Judge-II, Latehar.
On 18.04.2021, on the basis of confidential information that extremists had gathered near Rajgurutola Jhiruhula, Balumath Police raided the place of occurrence. On seeing the police party, extremists opened fired upon them.
It was submitted that petitioner was neither apprehended at the spot nor anything was recovered from his possession. It was further submitted that the name of the petitioner has transpired on the basis of confidential information given by the witnesses, whose names have not been disclosed. It was finally submitted that several co-accused persons have been granted bail by this Court earlier.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Latehar, in connection with Balumath P.S. Case No. 71 of 2021, S.T. Case No.168 of 2021.
