Heard learned Counsel Mr. M.Mandal for the petitioner Juwel Khan who has filed this application under Section 483 of the BNSS, 2023 with a prayer for bail as he is behind bars since 29.01.2025 in connection with Hatigaon PS Case No. 18/2025 under Sections 309(4)/109/117(2)/317(4) of the BNS. Page No.# 2/3 2. Learned Addl.Public Prosecutor Mr. K.K.Das is present for the respondent State. 3. The allegation against the petitioner is that he has been involved in a robbery of snatching a purse from one Mrs. Biju Sarma, a 72 years old lady. 4. Learned Addl.Public Prosecutor has raised serious objection stating that the petitioner is a history sheeter and he has been arrested in several cases of robbery as well as in a case of dowry death. If the petitioner is enlarged on bail, the investigation may be adversely affected. It is further submitted that there are incriminating materials in the Case Diary against the petitioner. 5. It is submitted on behalf of the petitioner that the petitioner is undergoing treatment at GMCH as he tried to escape from police custody. It is further submitted that the petitioner is not in a condition to move due to his health condition and he is the sole bread winner of the family. 6. I have scrutinized the Case Dairy. After scrutiny of the Case Diary, it reveals that investigation has substantially progressed. 7. Considering all the aspects, the prayer for bail is allowed. 8. The petitioner named above shall be released on bail on furnishing bail bond of Rs.50,000/- with 02(two) suitable sureties of like amount to the satisfaction of the learned CJM, Kamrup (M), Guwahati subject to the following conditions: i) The petitioner shall co-operate with the investigation and shall not exercise any threats to the witness, ii) The petitioner shall appear before the I.O. every fortnight till completion of the investigation, Page No.# 3/3 iii) The petitioner shall refrain from committing any such activities of which he is alleged, iv) The petitioner shall not leave the jurisdiction of the Court without prior permission. 9. On breach of any of the above conditions, learned court is at liberty to immediately cancel bail granted to the petitioner. 10.
