It is submitted by the learned counsel for the Petitioner that in view of the pendency of Election Petition Case No.05 of 2025 which is presently on the file of learned Additional District Judge, Khariar at the instance of Opposite Party No.3 wherein the Petitioner has been arrayed as Respondent No.1 whereby the selection of the Petitioner as Chairman of Panchayat Samiti is under challenge, Misc. Case No.9 of 2025 instituted before the Collector is not maintainable. The order-sheet in the said Misc. Case is on record. It indicates that the Petitioner has participated in the said proceeding pursuant to the notice issued. 3. In view of the same, the writ petition is disposed of giving liberty to the Petitioner to pursue the matter before the Collector, Nuapada inter alia bringing to his notice that in view of the schematic arrangement of the Act and the institution of proceeding before the designated Judicial authority, the Collector has no jurisdiction to entertain the same. 4.
