JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 3 13-10-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. 2. The petitioners are apprehending their arrest in connection with Ander P.S. Case No. 296 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 74, 125(a), 109, 352, 351(2) and 3(5) B.N.S., 2023 and Section 37 of the Bihar Prohibition and Excise Act. 3. As per the prosecution case, when the son of the informant Meraj Ansari ploughing the field by a tractor and playing the song in the tractor the co-accused namely Bolbam Yadav came there and raised objection on playing the song,

It is further alleged that co- accused persons Bolbam Yadav, Mithun Yadav, Bhola Yadav, Manager Yadav came in a drunken condition along with wife and grandson of Manager Yadav and assaulted the informant and her family members. 4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to petty dispute of playing vulgar song by the son of the informant while he was ploughing the field of Lalu Yadav, in which a free fight has taken place between the parties in which both sides received simple injuries. He further submits that there is general and omnibus allegation against the petitioners. Petitioner nos. 1 and 2 have no criminal antecedent, whereas, petitioner no. 3 has one criminal antecedent in which she is on bail. Petitioners undertake to cooperate in the investigation and trial of this case. 5.
