IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No. 1336 of 2025 Sudhansu Bariha …. Petitioner Represented by Mr.P.K.Samantray, Advocate -Versus - State of Odisha and Others …. Opposite Parties Represented by Addl. Standing Counsel . CORAM: JUSTICE SASHIKANTA MISHRA ORDER 16.01.2025 1. This matter is taken up through hybrid mode. 2. Heard learned counsel for the petitioner and learned counsel for the State. 3. The petitioner was engaged as Gram Rozgar Sevak in Bhengarajpur G.P. under Paikmal Block in the district of Bargarh. He was disengaged by order dated 28.08.2015. He approached this Court against such order of disengagement in W.P.(C) No.37338 of 2020. By order dated 15.11.2021, this Court disposed of the writ petition by holding that the case was covered by an earlier judgment of this Court in the case of Manas Kumar Swain v. State of Odisha, 2020(I) ILR-CUT-357, wherein it was observed that the authority cannot curtail the agreement without any rhyme reason during subsistence of the same. Pursuant to such order, the petitioner was again engaged as Gram Rozgar Sevak by order dated 10.05.2022. His grievance is that the period from his Order No. 1. disengagement till reinstatement, i.e. 28.08.2020 to 17.05.2022 has not been taken into account and a fresh engagement order has been issued, even though his earlier disengagement was set aside. Highlighting his grievance, the petitioner has approached the Collector, Bargarh by submitting a representation on 06.08.2022. Said representation is pending. 4. Considering the above fact, the writ petition is disposed of directing the Collector, Bhadrak to consider the representation submitted by the petitioner and to pass a reasoned order disposing of the same as early as possible preferably, within a period of one month from the date of production of certified copy of this order by the petitioner.
