The petitioner has been made accused in connection with Bharno P.S. Case No.61 of 2024 registered under Sections 20(b)(ii)/22 of N.D.P.S., Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is a co-driver of a passenger bus from which police recovered 10.410 Kgs. of Cannabis. It is submitted that the allegation against the petitioner is false. It is next submitted that the bag belonged to a passenger travelling in the bus. It is next submitted that the quantum of Cannabis seized comes within the intermediate quantity. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-13 of this bail application. It is also submitted that the co- accused, with similar allegations, has already been released on bail by a co- ordinate Bench of this Court vide order dated 19.12.2024 passed in B.A. No.10747 of 2024. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 26.10.2024 as is evident from para-17 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gumla in connection with Bharno P.S. Case No.61 of 2024 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
