JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 3 14-10-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 192, 126(2), 115(2), 303(2), 76, 352, 351(2) of the Bhartiya Nyaya Sanhita and later on, Section 109 of B.N.S. was added. 3. The informant, who is ward member, has alleged that on 09.03.2025 at about 02:30 pm, while he was roaming in the area, he saw that petitioner no. 1 was throwing garbage here Patna High Court CR. MISC. No.56141 of 2025(3) dt.14-10-2025 2/3 & there and when informant objected, petitioner no. 1 abused him. It is further alleged that all the named accused persons including petitioners came to his house and started misbehaving with his wife and also assaulted other family members and when informant reached there, petitioner no. 4 (Ripu Ranjan), other co-accused Terani & Bhim Singh along with 10-12 other persons attacked him by means of lathi-dadna and also snatched gold mangalsutra from informant's wife and mangalstura from informant’s niece. Later on, out of four injured persons, one lady namely Rajani Devi died during treatment. 4. Learned counsel for the petitioners submits that from bare perusal of F.I.R., it is apparent that sudden quarrel arose between the parties over throwing of garbage, which resulted in Maarpit in which both sides sustained injury. Case and counter case. Allegation of assault is general and omnibus. The act was committed without deliberation in a sudden fight in the heat of passion. He further submits that in the post-mortem report of deceased (Rajani Devi), the doctor has opined that “Death is due to sepsis consequent to prolonged hospital stay and persistent vegetative state.” Petitioners claim clean antecedent. 5. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Buxar (Muffasil) P.S.
