HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22263 of 2025 Court No. - 45 HON'BLE SALIL KUMAR RAI, J.
HON'BLE ZAFEER AHMAD, J. The present writ petition has been filed challenging the impugned First Information Report dated 18.09.2025 lodged as Case Crime No. 286 of 2025, under Sections 318(4), 316(2), 338, 336(3), 340(2), 61(2) of The Bharatiya Nyaya Sanhita, 2023, Police Station Sadar Bazar, District Mathura. It has been argued by the counsel for the petitioners that the dispute revealed through the recital in the first information report is civil in nature and criminal proceedings cannot be instituted on the allegations made in the first information report. It has been further argued that the petitioner nos. 1 & 2 are purchasers of the suit property and the petitioner nos. 3 & 4 are the attesting witnesses of the sale deed. It has been argued that in view of the aforesaid no offence under Sections 318(4), 316(2), 338, 336(3), 340(2), 61(2) of the B.N.S. is made against the petitioners and the first information report is liable to be quashed. The AGA has opposed the petition. It would serve no useful purpose to keep the writ petition pending. In the circumstances of the case and after considering the rival submissions of the counsel for the parties, the writ petition is disposed of with a direction that the petitioners shall not be arrested in pursuance to the First Information Report dated 18.09.2025 lodged as Case Crime No. Versus Counsel for Petitioner(s) : Ajeet Kumar Chaurasiya, Namit Kumar Sharma Counsel for Respondent(s) : G.A.
