1. After arguing for some time, learned counsel for the petitioner has prayed for withdrawal of the present petition by submitting that the present is a second petition filed under Section 11 of the Arbitration and Conciliation Act, 1996 which would not be maintainable because in the earlier petition under Section 11 of the Arbitration and Conciliation Act, 1996, an Arbitrator has already been appointed vide Annexure P-3. He further submitted that the arbitration proceedings are already going on and his only grievance is that some of the parties, who are the necessary parties have not been joined by the learned Arbitrator and therefore, liberty may be granted to the petitioner to move an appropriate application in this regard to the learned Arbitrator.
2. The request made by learned counsel for the petitioner for withdrawal of the present petition is accepted.
3. The present petition is dismissed as withdrawn.
