Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 B.N.S.S., 2023 seeking transfer of Case No. 227 of 2023, titled Priti Singh and another Vs. Anand Pratap Singh, under Section 125 Cr.P.C., pending before the Principal Judge, Family Court, Mirzapur to the court of competent jurisdiction at Prayagraj. Applicant-husband seeks indulgence of this Court for transfer of the maintenance case instituted against him by his wife- opposite party no.2 at Mirzapur on the sole ground that the applicant being resident of Prayagraj, is finding it difficult to defend the case, as he is also taking care of his ailing mother. He prays that the pending case be transferred from Mirzapur to Prayagraj. During the course of hearing, it is not disputed by learned counsel for the applicant that the applicant's mother has suffered fracture of leg, which is not a permanent ailment. Further, the distance between two towns is only 60 kilometers, therefore, no case is made out for transfer of the case. The application is dismissed.
