Prayer in the instant petition filed under Section 528 of the BNSS is for issuance of direction to respondents no. 2 and 3 to arrest accused/respondent no. 4 in FIR No. 189 dated 25.08.2024 under Sections 406, 420 IPC registered at Police Station Sadar Jalandhar. 2. Learned counsel for the petitioner submits that the accused/respondent no. 4 has been declared a proclaimed offender in the abovesaid case . He has been threatening the petitioner to compromise the matter. The petitioner has also moved representation, Annexure P-6, to the authorities but no action has been taken so far. He prays that a direction be issued to respondents no. 2 and 3 to take action to arrest the accused/respondent no. 4 in the present case. Learned State counsel, who appears on advance notice, apprised the Court that in the present case, after dismissal of bail application of respondent no. 4 on 01.07.2024, he was declared a proclaimed offender on 27.08.2024 and a report under Section 173 Cr.P.C. stands filed and next date of hearing for evidene of police officials is 18.10.2025. So the petitioner has a remedy available to approach the competent Court. 4. Heard. 5. Accordingly, at this stage, without commenting on the merits of the case, the writ petition is disposed of and the petitioner is at liberty to pursue his case before the appropriate forum.
