JUSTICE SUSMITA PHUKAN KHAUND ORDER 28.03.2025 Heard learned counsel, Mr M U Mondal, for the petitioners, 1) Jalal Uddin @ Jala Uddin, 2) Jamat Ali and 3) Sheikh Sahalom, who have filed this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail, as they are behind bars since 22.02.2025, in connection with Bilasipara PS Case No. 54/2025, under Section 303(2) of the BNS, 2023, read with Section 13(1) of the ACP, read with Section 11 of the Cruelty of Animal Act. 2. Heard Mr K Baishya, learned Additional Public Prosecutor, Assam for the respondent State. 3. The allegation against the petitioners is regarding theft of cattle. 4. The petitioners are already behind bars for 34 days. It appears that further custodial detention may not be required for the progress of investigation. 5. Considering all aspects, the petitioners are enlarged on bail on furnishing a bail bond of Rs. 30,000/- (Rupees Thirty Thousand Only) each with a suitable surety of like amount to the satisfaction of the learned SDJM (M), Bilasipara, under the conditions that- i) the petitioners shall refrain from such activities with which they are alleged, Page No.# 3/3 ii) the petitioners shall appear before the IO, on every fortnight, till completion of investigation, and iii) the petitioners shall not leave the jurisdiction of the Court, without prior permission. 6.
