Following orders were passed by this Court on 12.09.2025:- 1. “The petitioner No.1-Institution is an established Ayurvedic Medical College. The National Commission for Indian System of Medicine, Ministry of Ayush, Government of India, has issued a communication on 04.09.2025, permitting the petitioner-Institution to commence the AYUSH course in the current academic sessions i.e. 2025-26, by admitting 100 students. The grievance of the petitioners is that notwithstanding such permission granted by the competent authority, the authorities of the State of Haryana have not included the petitioner-Institution in the counselling which commenced w.e.f. 10th of September, 2025. On an advance notice of this Writ Petition, Mr. Saurabh Mohunta, DAG, Haryana has appeared along with Dr. Sushma Nain, Deputy Director, Ayush Department, Haryana and on the basis of instructions obtained from her, learned State counsel does not dispute the fact that the petitioner-Institution has the requisite eligibility to run the course in question. It is stated that since the permission has come very late, it was not possible to include the name of the petitioner-Institution for the counselling. 3. Considering the fact that the competent authority has already granted necessary recognition to the petitioner- Institution and by virtue of orders passed by the National Commission, the petitioner-Institution is permitted to admit 100 students, we are of the view that exclusion of the name of the petitioner-Institution in the counselling, would not be legal. 4. In such circumstances, we issue an interim mandamus to the State authorities to forthwith include the name of the petitioner-Institution in the ongoing counselling. Since, this order has been passed in presence of the Deputy Director, Department of AYUSH, the State authorities shall ensure that the petitioner-Institution is included in the ongoing counselling from today itself. 5. Learned State counsel would file their specific affidavit in response to the Writ Petition within period of 10 days. Mr. Saurabh Mohunta, DAG, Haryana appears on behalf of the respondents and files reply by way of an affidavit dated 18.09.2025 of Sh. Vijender Hooda, Additional Director (Admn.) AYUSH Department, Haryana, Panchkula, on behalf of respondents No.1 & 2. The said affidavit is taken on record. The Registry is directed to tag the same in the case file at an appropriate place. 3. The stand of the respondents-State, as reflected in Paras 4 and 5 of the reply, reads as under :- “4. That in compliance with the order dated 12.09.2025, Sanskaram Ayurvedic Medical College and Hospital has been permitted to participate in the ongoing counselling, and the name of the college has been duly updated on the counselling portal for admissions to the UG (BAMS/BHMS) courses for the academic session 2025-26. The relevant documents are attached herewith as Annexure R-1. 5. That the matter regarding grant of relaxation to private universities established under the Haryana Private Universities Act, 2006, for the purpose of affiliation with Shri Krishna AYUSH University, Kurukshetra, is presently under consideration with the Government. It is further submitted that the deponent holds the Hon'ble Court in the highest esteem an article of faith and justice and can never violate or disobey the directions passed by this Hon'ble Court. In view of the stand taken by the respondents-State, we find that the grievance of the petitioners, as is raised in the present Writ Petition, stands redressed. 5. Accordingly, the present Writ Petition stands disposed of. 6. All pending applications, if any, in this case are disposed of accordingly.
