2025:UHC:7189-DB 1 IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL HON’BLE THE CHIEF JUSTICE SRI G. NARENDAR AND HON’BLE SRI JUSTICE ALOK MAHRA 14TH AUGUST, 2025 WRIT PETITION (PIL) No. 676 OF 2025 Veeresh Jain …..Petitioner Versus State of Uttarakhand and others. …Respondents Counsel for the petitioner. : Mr. Aditya Singh, learned counsel. Counsel for the respondents : Mr. B.S. Parihar, learned Additional Chief Standing Counsel for the State. Mr. Rahul Consul, learned counsel for respondent Nos. 2 and 3. JUDGMENT : (per Sri G. Narendar, C.J.) The matter was listed yesterday and we had queried the learned counsel regarding the maintainability of the writ petition. 2. Today, learned counsel for the petitioner would submit that he has impugned the proceedings dated 08.08.2025, which has proposed to commence the sealing of the construction on 14.08.2025, i.e. today. 3. The sealing proceedings are apparently pursuant to the orders passed by this Court in the connected Writ Petition (PIL) No. 91 of 2025 on 21.07.2025. 4. In that view, if the writ petition is entertained, it would virtually amount this Bench sitting in Appeal and act as 2025:UHC:7189-DB 2 an appellate Court over its own order in related proceedings, which in our opinion, is impermissible. That apart, learned counsel for the petitioner, in the relate Proceedings, i.e., the PIL, Sri Piyush Garg, submits that he has also preferred an application to array the instant petitioner as a party respondent in the connected Writ Petition (PIL) No. 91 of 2025. 5. Learned counsel for the petitioner prays leave to withdraw the writ petition with liberty to file an Application in Writ Petition (PIL) No. 91 of 2025 to come on record. 6. The submission of the learned counsel for the petitioner is placed on record. 7. Accordingly, reserving such liberty, the writ petition is dismissed as withdrawn. 8. Pending application, if any, also stands dismissed. _______________ G. NARENDAR, C.J. _____________ ALOK MAHRA, J.
