Petitioner has preferred this petition under Section 439 (2) of the Cr.PC for cancellation of anticipatory bail granted to the respondent No.1/accused by this Court in MCRCA No.784/2020. 2. As per report received from the learned Special Judge, Durg, challan/charge-sheet was filed against the respondent No.1/accused on 18.08.2022 and based upon which charges has been framed on 19.09.2022. Ten witnesses have already been examined before the trial Court, evidence of accused has been recorded on 12.09.2024 and, thereafter, case was fixed on 30.01.2025 for defence witness. 3. It is pertinent to mention here that on 07.08.2020, this Court has granted anticipatory bail to the respondent/accused, however, after lapse of five years, this petition has been filed for canceling the anticipatory bail of the accused. 4. When the matter is called out for hearing, none appeared on behalf of the petitioner. Even in the second call, there is no representation on behalf of the petitioner. 5. In view of the above, this Court is left with no other option but to dismiss the petition for want of prosecution. 6. Accordingly, the petition is dismissed for want of prosecution. CC as per rules.
