Petitioners apprehend arrest in a case registered for the offences punishable under Sections 447, 341, 323, 324, 307, 379, 427, 504, 506/34 of the Indian Penal Code. 3. It is alleged that all the F.I.R. named accused persons, including these petitioners, armed with deadly weapons, came at the door of informant and started abusing his grandson. Petitioner no. 1 is alleged to have assaulted cousin brother of informant with lathi and petitioner no. 2 assaulted grandson of the informant with farsa as a result of which they sustained multiple injuries. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Both parties are co-villagers and due to petty dispute, quarrel took place between them. Injuries sustained by the injured are simple in nature. Rest of the allegations are ornamental only to make the case grave. Petitioners claim clean antecedent. 5. Learned A.P.P. for the State vehemently opposed the bail application. 6. Considering the nature of accusation, injuries and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs.
10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Simri Bakhtiyarpur (Kanariya O.P.)
