JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 07-10-2025 Heard Mr. Krishna Prasad Singh, learned senior counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State. 2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 329(4), 126(2), 115(2), 352, 351(2), 74, 109(1), 303(2) and 3(5) of the B.N.S.. 3. As per prosecution case, it is alleged that this petitioner assaulted mother of informant, namely Sugiya Devi, by means of iron rod. 4. It is submitted by learned senior counsel appearing on behalf of the petitioner that petitioner is quite innocent and Patna High Court CR. MISC. No.69731 of 2025(2) dt.07-10-2025 2/2 has committed no offence. As a matter of fact, both parties are agnates and due to petty dispute, a simple maar-peet took place between the parties in which both sides sustained injuries. There is case and counter-case. Petitioner claims clean antecedents. 5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he assaulted on the head of mother of informant, namely Sugiya Devi. Doctor has opined the injuries sustained by Sugiya Devi as grievous in nature. 6. Considering the facts and circumstances of the case, specific and direct nature of accusation and nature of injuries sustained by the injured, the prayer for grant of anticipatory bail to the petitioner is rejected. shashank/- (Prabhat Kumar Singh, J) U T
