This Habeas Corpus Petition has been filed to produce the petitioner's wife viz.,Umamagheshwari aged about 24 years W/o R.Raja Sekar and his minor son viz.,Dharshan before this Court and set them at liberty on the basis of the FIR in Crime No.498 of 2025 dated 27.08.2025 by considering his representation dated 01.09.2025. 2. Pursuant to the notice already ordered by this Court, today the respondent police has produced the detenue and her son. We have interacted with the detenue, who would submit that due to the misunderstanding with the petitioner ie., the husband of the detenue, she has left her matrimonial home some time in August 2025 and she has taken a house on her own for rent, where both the detenue and her son are residing. She would further submit that, as of now she is not ready and willing to go back to her matrimonial home to join her husband / petitioner. 3. Having taken the above stand of the detenue, we find that the detenue and her son is not in illegal custody anywhere.
