The brief facts of the case are thatAl andA2 are in the habit of consuming ganja and they often purchase ganja from A4 and consuming ganja. As Al and A2 have no money for their vices, they were also selling ganja by purchasing ganja from A4. Al and A2 also got friendship with A3, A5 and Juvenile No.1/Kill'veti Akshay Kumar @ Ammu. While so, two months back Al and A2 purchased 6 kgs of ganja from A4 and selling the same in small quantity. Due to fear of police, Al and A2 escaped from the village with remaining ganja. on 12.07.2023, A3, A5 and Juvenile No.1 went to Kotapoluru VI'IIage for consuming ganja and approached Al and A2 and asked GanJ-a. Later, Al and A2 brought Tanja and whI-Ie issuing ganja to A3, A5 and Juvenile No.1, meantI'me, POIice captured them. The complainant found 2 packets of ganja weighing about each Packet COntaI-ning 2 kgs total 4 kgs of ganja was seized from the possession Of accused in the presence of mediators under cover of mahazamama, basing on which, a case in the above crime was registered. 4. Learned COunSel for the Petitioner Submits that the petitioner/A6 was remanded tO judiC'lal custody upon the production of a p.T.Warrant and has been judicial Custody Since o3.01.2025. He further Submits that, based On confessions Of co-accused, the case was registered against the petitioner/A6, and no contraband was seized from him. The learned COunSel for the petitioner further submits that the petitioner has a permanent abode at polambanda village, chinthapalli Mandal, Alluri Seetharama Raju District, and there iS nO POSSibility Of his flee'lng away from the Jurisdiction Of the Court. 6. Learned Assistant Public Prosecutor, While OPPOSing the prayer of the petitioner, subm'ItS that the investigation iS not complete. when ascertained the learned Ass'lstant Public prosecutor confirmed that the petitioner has one criminal antecedent. 7. ln view Of the facts and Circumstances Of the Case, SInCe the petitioner herein is arrayed as accused No.6 basing On the confessional statement of co-accused and no contraband was seized from him, this court is of the opinion that the release of the present petitioner would not hinder the investigation in anyway.
