HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34300 of 2025 Court No. - 6 HON'BLE DR. YOGENDRA KUMAR SRIVASTAVA, J. On an oral prayer, counsel for the petitioner is permitted to correct the array of the parties. Heard Sri Balbir Singh, learned counsel for the petitioner and Sri Anand Bhaskar Srivastava, learned Standing Counsel appearing for the State- respondents. The present petition has been filed seeking to assail the orders dated 26.05.2023 11.07.2025 passed in proceedings under Section 67 of the U.P. Revenue Code, 2006. It is not disputed that the aforesaid orders would be subject to a further statutory remedy under the U.P. Revenue Code, 2006 and in view thereof the present petition would not be entertainable. In the writ petition itself it has been averred that the petitioner has preferred an appeal being Appeal No. D202518020013234 of 2025 (Yasmeen Zaidi vs. State of U.P. through Collector, Aligarh) against the aforestated orders. Counsel for the petitioner accordingly submits that he does not wish to press the reliefs as prayed for in the writ petition. Learned counsel prays for an alternative relief by seeking a direction to the respondent no.5, Additional District Magistrate (Judicial), Aligarh to decide the aforesaid appeal expeditiously. Versus Counsel for Petitioner(s) : Balbir Yadav Counsel for Respondent(s) : C.S.C. Yasmin Zaidi .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) Counsel for the State-respondents has no objection to the appeal being expedited. Having regard to the aforesaid, the present petition is disposed of with an observation that the respondent no.5, Additional District Magistrate (Judicial), Aligarh, would make an endeavor to conclude the proceedings of the aforestated appeal, which is stated to be pending before it, preferably within a period of six months, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
