No. 859 of 2025 PRAYER This writ petition has been filed under Article 226 of the Constitution of India to issue a writ of mandamus directing directing the 1st Respondent to transfer petitioner complaint dated 13/11/2024 along with case file to the 2nd Respondent for further investigation of the case and may pass any other further or other orders as this Hon'ble Court. Advocate (crl.side) ORDER This writ petition has been filed seeking a writ of mandamus directing the first respondent to transfer the complaint of the petitioner to the 2 nd respondent for further investigation. 2. The case of the petitioner is that he is a business man in iron scrap and engages in seasonal business. For better services to customers, he was using 50 2/6 https://www.mhc.tn.gov.in/judis WP Crl. No. 859 of 2025 G-pay machines and 50 card-swiping machines, which were supplied by the bank for crediting amounts into the petitioner's account. The business during the Diwali season lasted for about 7 to 10 days. Only thereafter, the petitioner verified his account. Though the petitioner should have received about Rs.1,30,77,320/- only Rs.60,28,541/- was credited and the remaining about Rs.67,94,729/- was not credited to his account. Since this involved a huge monetary discrepancy, the petitioner approached the bank, but the bank officials were evasive. Hence, the petitioner lodged a complaint. Despite the complaint, no effective action was taken, leading the petitioner to approach this Court seeking transfer of investigation. 3. The learned Government Advocate (crl.side) appearing for the respondents would submit that all the G-pay machines and card swiping machines had been collected. However, the transactions might also have been carried out through other modes, such as QR codes, etc. and the petitioner had not furnished those details. 3/6 https://www.mhc.tn.gov.in/judis WP Crl. Considering the nature of the allegations and the fact that substantial amounts are involved, this Court is of the view that the investigation should be conducted by the Cyber Cell headed by the Deputy Commissioner of Police, Avadi. 5. Accordingly, this Court directs that the investigation shall be carried out by the Cyber Cell, Avadi under the supervision of the Deputy Commissioner of Police. The Cyber Cell is further directed to complete the investigation and file a final report as expeditiously as possible. 6.
