Hon'ble Donadi Ramesh,J. Petitioner alleges that unauthorized job-card was prepared by the authorities and payment was released though work was not conducted. The prayer in the writ petition is to direct the respondent authority to make proper inquiry on the spot and punish the person whose found involved in such forgery. Records reveal that in the administrative inquiry, the allegations have been found incorrect. Amount payable for such job-work is already credited to the account of petitioner's family member. Even otherwise, if the petitioner alleges any offence to have been committed then the remedy would be to lodge a police report or to approach the Magistrate under Section 175(3) B.N.S.S. A writ petition would not lie for factual ascertainment of alleged illegality when the claims are disputed and petitioner is himself a beneficiary. Dismissed.
