Heard learned counsel for the petitioner and learned Standing Counsel for the respondents. 2. By means of the present writ petition, the petitioner has assailed the notice/order dated 17.06.2025 whereby he has been asked to deposit Rs.3 Lacs as penalty for illegal mining. 3. It is contended by learned counsel for the petitioner that the show cause notice was given to the petitioner on 19.07.2025 in respect to the charge of illegal mining done by the petitioner. The petitioner has denied the aforesaid charge by submitting objection to the said notice. It is contended that it is manifest from the impugned notice/order that the impugned notice/order refers to the objection filed by the petitioner but the impugned notice/order does not record any finding as to why the objection of the petitioner is not sustainable in law. Accordingly, it is contended that the impugned order is non-speaking and without application of mind. 4. Learned Standing Counsel would contend that the Mining Inspector, Mathura while passing the notice/order has recorded a cogent reason in concluding that the petitioner was doing illegal mining and therefore, the penalty has rightly been imposed. Be that as it may, we have perused the impugned notice/order dated 17.06.2025 which reads as under:- एतद्षारा आपको सूिचत िकया जाता है िक उपिजलािधकारी मांट के प्ऴ संख्या 622/एस.टी/2023 िदनांक 13.07.2023 के साथ संलग्न तहसीलदार मांट की आख्या िदनांक 19.06.2023 के अनुसार आपके ्षारा तहसील मांट के ्षाम िकनारई बांगर के गाटा संख्या 121 रकबा 1.7940 है० भूिम से लम्बाई 58 मीटर × चौड़ाई 30 मीटर x गहराई 1.5 मीटर = 2610 घन मीटर साधारण िम्टी का अवैध खनन िकया गया है। उ्व कृ त्य उ०्ऺ० उप खुिनज पिरहार िनयमावली 2021 के िनयम 3 का उल्लंघन होने पर आपको िलिखत उ्तर/जवाब ्ऺस्तुत िकये जाने हेतु नोिटस संख्या 599/खिनज/अवैध खनन/पिरवहन/2023-2024 िदनांक 19.07.2023 भेजा गया, नोिटस के ्वम में आपके ्षारा िलिखत उ्तर िदनांक 24.08.2023 ्ऺस्तुत िकया गया, िजसपर सम्यक िवचारोपरान्त जवाब को सन्तोषजनक न पाये जाने पर िनरस्त करते हुए साधारण िम्टी के अवैध खनन पर उ्तर ्ऺदेश उपखिनज (पिरहार) िनयमावली 2021 के िनयम 58 के ्ऺािवधानानुसार िजलािधकारी महोदय के आदेश िदनांक 16.06.2025 के अन्तगर्त अथर्दण्ड रू० 3,00,000.00 अिधरोिपत िकया गया है। अतः आप उपरो्वानुसार अथर्दण्ड रू० 3,00,000.00 की धनरािश को 15 िदन के अन्दर िनधार्िरत लेखा शीषर्क 085300 800 01 00 में जमा कराना सुिनि्ात् करें, अन्यथा भू-राजस्व की भाँित वसूली हेतु िनयमानुसार अि्षम कायर्वाही की जायेगी, िजसके िलए आप स्वयं उ्तरदायी होंगे। 17/06/25 खान िनरी्षक मथुरा। 6. From perusal of the aforesaid notice/order, it is evident that the objection of the petitioner has not been considered by the competent authority. Further, the order dated 16.06.2025 has also not been supplied to the petitioner. 7. Since the impugned notice/order is non-speaking and without application of mind, therefore, it is not sustainable in law. 8. Consequently, we set aside the impugned notice/order with liberty to the respondent No.2 to pass a fresh order strictly in accordance with law after giving due notice and opportunity of hearing to the petitioner and after supplying all the material which he wants to rely upon against the petitioner. WRIC No. 34086 of 2025 2 9. Thus, for the reasons given above, the writ petition is allowed with no order as to costs. 10. It is made clear that if there is any concealment of fact by the petitioner in obtaining the present order, the respondents shall have the liberty to file recall application to recall the said order.
