A case has been registered against the petitioner herein and others for the offences punishable under sections 8(c) r/w / __/ \=- Eral e±irsg6€ 2 20(b)(ii)(B) of the N;ricotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS A6t'). 3. The brief facts of the case are that on 14.04.2023 at about 2.30 p.m., on receipt of credible information about the illegal possession of ganja, the Enforcement Inspector of Police, along with his staff and mediators, rushed to vegetable shop (towards Ayyappagudi), Current Office Center, Nellore City noticed two persons who stood and having whl'te colour plastic bags in their hands. On suspicious, the Enforcement Inspector of Police with help of staff caught hold the two persons and on sear in that plastic bags and seized four kgs of ganja. 4. Heard. Perused the record. 5. Learned counsel for the petitioner submits that the petitioner/A7 was remanded to judicial custody upon the production of a P.T.Warrant and has been judicial custody since 03.01.2025. He further submits that, based on confessio'ns of co-accused, the case was registered against the petitioner/A7, and no contraband was seized from him. The learned counsel for the petitioner further submits that the petitioner has a permanent abode at Polambanda Village, Chinthapalli MandaI, E= -_.==_~==* ```` 3 Jy Alluri Seetharama Raju District, and there iS nO POSSibility of his fleeing away from the Jurisdiction of the Court. 6. Learned Assistant Public Prosecutor, while OPPOSing the prayer of the petitioner, submits that the investigation is not complete. when ascertained the learned Assistant Public prosecutor confirmed that the petitioner has one criminal antecedent. 7. ln view of the facts and Circumstances Of the Case, Since the petitioner herein is arrayed as accused No.7 basing on the confessional statement of co-accused and no contraband was seized from him, this court is of the opinion that the release of the present petitioner would not hinder the investigation in anyway.
