Basic Education Board, Prayagraj. ii. To issue a writ, order or direction in the nature of certiorari quashing the impugned list dated 30.06.2025 (Annexure-3) so issued by respondent no. 2 insofar as it relates to petitioner treating to have been absorbed for the reason the same amounting to discriminatory tactics adopted by respondent no. 1 and 2. iii. To issue a writ, order or direction in the nature of mandamus commanding respondents not to treat petitioner to have been absorbed in another primary school as per list dated 30.06.2025 (Annexure-3) to further rebut petitioner in the same post of Head Master in the same primary school in which he was working prior to issuance of circular dated 23.05.2025 (Annexure no. 1) and the first list so issued declaring petitioner to be surplus liable to be absorbed in another institution and decide the petitioner's representation dated 07.07.2025 (Annexure No.4). The petitioner was initially appointed as Assistant Teacher on 10.02.1999 in Primary School, Nagla Gadriya, Block Jalesar, Etah. Later, he was promoted as Headmaster at Uchcha Primary School, Sona Jalesar, Etah, on
08.01.2007. In view of relevant Government Orders dated 23.05.2025 and 16.06.2025, the petitioner opted for his transfer, and accordingly he was transferred to the place of his choice by order dated 30.06.2025. Learned counsel for the petitioner submits that now the petitioner does not want to go at the transferred place as there are few teachers who had also placed their option for being transferred but they are not being asked for joining at the transferred place. wants to remain at his original place. For the said purpose, he has represented before the authorities concerned but to no avail. Mr.
Suresh Kumar Maurya, learned counsel for the respondent BSA submits that in view of the Government Order, once the petitioner has willingly exercised his option for transfer, he cannot withdraw from the same. Having considered the submissions advanced by learned counsel for the parties, I do not find it a fit case to be interfered with. The writ petition lacks merit. It is accordingly dismissed. No order as to costs. September 24, 2025 DS WRIA No. 14608 of 2025 2 (Mrs. Manju Rani Chauhan,J.) Digitally signed by :- DIGAMBER SINGH High Court of Judicature at Allahabad
