JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 2 07-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Waini P.S. Case No. 49 of 2025, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act. 3. As per the prosecution case, total 411.480 litre illicit liquor was recovered from a Manindra Scorpio bearing Registration No. DL2FD 0041. It is alleged that petitioner on his Pulsar motorcycle was escorting the said Scorpio vehicle and on seeing the police force he fled away from the spot. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case being owner of the Pulsar motorcycle bearing Registration No.
Patna High Court CR. MISC. No.67876 of 2025(2) dt.07-10-2025 2/2 BR33AR9807. No incriminating material has been recovered from the motorcycle of the petitioner. Petitioner had no knowledge about the liquor kept in the Scorpio vehicle. Only on the basis of suspicion, his name has been implicated in this case. Driver of the Scorpio vehicle had not disclosed the name of the petitioner. Petitioner has no criminal antecedent. He undertakes to co-operate in the investigation and trial. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner. 6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the Petitioner, above-named, be released on bail upon furnishing bail bonds of Rs.
10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Samastipur in connection with Waini P.S.
