Apprehending his arrest, the petitioner has moved this Court for grant of privileges of anticipatory bail in connection with Bhandariya P.S. Case No.43 of 2024 registered under Sections 302 and 201 of the I.P.C., the petitioner has moved this Court for grant of privileges of anticipatory bail
Learned counsel for the petitioner submits that the allegation against the petitioner is that petitioner committed murder of Sajbun Khatoon along with co-accused persons, being unhappy with the love affairs of Sajbun Khatoon with one Bishesh Kumar and caused disappearance of evidence of murder by hiding the dead body under sand and stones. It is next submitted that the allegation against the petitioner is false. It is further submitted that petitioner is the distant relative of the deceased Sajbun Khatoon. It is then submitted that save and except the confessional statement of co-accused, there is no material on record to implicate the petitioner in this case. Drawing attention of this Court towards para-16 of the anticipatory bail application, learned counsel for the petitioner submits that petitioner has no criminal antecedent. It is lastly submitted that petitioner is ready and willing to cooperate with the investigation of the case. Hence, it is submitted that the petitioner be given the privilege of anticipatory bail.
Learned Addl.P.P. appearing for the State vehemently opposes the prayer for grant of anticipatory bail to the petitioner and submits that there is direct and specific allegation against the petitioner for committing murder of Sajbun Khatoon in a brutal manner only because she was in love with one Bishesh Kumar. It is further submitted that the custodial interrogation of the petitioner is required during the investigation of the case. It is therefore submitted that the petitioner ought not to be given the privilege of anticipatory bail.
Considering the serious nature of allegation against the petitioner, requirement of his custodial interrogation during the investigation of the case, this Court is of the considered view that this is not a fit case where the petitioner be given the privileges of anticipatory bail. Accordingly, the prayer for grant of privileges of anticipatory bail of the petitioner is rejected.
