JUSTICE SUSMITA PHUKAN KHAUND ORDER 01.04.2025 Heard Mr. H.R.A. Choudhury, learned senior counsel for the petitioner, assisted by Ms. R. Deka, advocate and Mr. K. Baishya, learned Additional Public Prosecutor for respondent State. 2. The case-diary is received. 3. The petitioner apprehends arrest on the ground that he has been shown as the registered owner of a vehicle bearing registration No. NL-01-AD-6989. 4. In the FIR, it is alleged that from the said truck large consignment of sugar was stolen. 5. Mr. Choudhury has pointed out that in the certificate of registration of the said truck, the owner’s name is shown as Sabir Ahmed. According to Mr. Choudhury, the petitioner is not the owner of the said truck but his name has been shown to be the owner in the FIR and that is the reason why he apprehends arrest. 6. Vide order dated 17.02.2025, the petitioner was granted interim bail. The Page No.# 3/4 petitioner could not appear before the I.O. and he was booked in another case wherein he was granted pre-arrest bail by the learned Additional Special Judge, FTC, Cachar, in connection with Katigorah P.S. Case No. 08/2025. 7. The petitioner then filed an I.A. in connection with this present application, AB No. 203/2025, with prayer for extension of time to appear before the Investigating Agency and co-operate with the investigation. 8. Now, the case diary is before this Court and I have scrutinized the case diary. Investigation has progressed substantially. Indeed there are incriminating materials in the case diary against the petitioner and thus the learned Additional Public Prosecutor has raised objection against the bail petition. 9. However, I have considered the submission that the petitioner has already been granted interim bail in connection with this case. The petitioner is willing to appear before the I.O. and co-operate with the investigation and thus he filed the I.A. No. 297/2025. It is further submitted that the petitioner is not a flight risk as he is a local resident and he is willing to abide by any stringent bail conditions if imposed upon him. 10. Considering all aspects, interim order dated 17.02.2025, is hereby made absolute under the conditions that:- (i) the petitioner shall appear before the I.O. within one week and co-operate with the investigation, (ii) the petitioner shall refrain from such activities with which he is alleged, (iii) the petitioner shall appear before the I.O. on every fortnight till completion of investigation, and Page No.# 4/4 (iv) the petitioner shall not leave the jurisdiction of the Court without prior permission. 11. On breach of any of the bail conditions, bail order shall stand automatically cancelled. 12. In terms of the above observation, this bail application stands disposed of. 13.
