By way of the present application, the applicant seeks grant of anticipatory bail in case arising out of FIR bearing No.917/2023, registered at Police Station Kotwali, Delhi, for the commission of offences punishable under Section 174-A of the Indian Penal Code, 1860 (hereafter ‘IPC’). 2. Briefly stated the facts of the present case are that the petitioner was declared a ‘Proclaimed Person’ on 21.01.2023 by the learned Trial Court. The petitioner did not appear in the learned Trial Court despite notice/NBW/ proceedings under Section 82 of the Code of Criminal Procedure, 1973 (hereafter ‘Cr. PC’). Resultantly, the learned Trial Court had directed registration of present case vide order dated 28.06.2023. Therefore, present case was registered and investigation was taken up. 3. The learned counsel for the applicant/accused states that the parties have settled the disputes between the parties, and the offence in question has been compounded. The complainant, in case bearing CC No. 9332/2019, who is present in person, states that the matter has been amicably settled between the parties. 5. Keeping in view all the facts and circumstances mentioned hereinabove and that the applicant/accused undertakes to continue to join the investigation as and when required by the concerned Investigating Officer, this Court is inclined to grant anticipatory bail to the applicant, and in event of arrest, the applicant shall be released on his furnishing personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the SHO/I.O concerned on the following terms and conditions: i) The applicant shall join investigation, as and when called by the concerned IO/SHO and shall remain available on mobile numbers; shared by him with the Police. ii) The applicant shall not leave NCT of Delhi without prior permission of the concerned IO/SHO and shall also surrender her passport with the Police. iii) The applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner. iv) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned I.O/SHO. 6. The bail application stands allowed. 7. It is, however, clarified that nothing expressed hereinabove shall tantamount to an expression of opinion on merits of the case.
