HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 21831 of 2025 Court No. - 42 HON'BLE J.J. MUNIR, J.
HON'BLE PRAMOD KUMAR SRIVASTAVA, J. Vakalatnama filed by Mr. Satyendra Singh Yadav, Advocate on behalf of respondent no.3, is taken on record. Let it be numbered by the office, if not already numbered. Heard Mr. Lallan Prasad, learned counsel for the petitioners, Mr. Satyendra Singh Yadav, learned counsel for respondent no.3 and Mr. S.S. Tiwari, learned A.G.A. for the State-respondents. This writ petition has been filed seeking to quash the First Information Report dated 05.09.2025 giving rise to Case Crime No.0164 of 2025, under Section 137(2) of the B.N.S., 2023, Police Station Harpur Budhat, District Gorakhpur. According to the FIR, the informant's 12 years old daughter has been taken away by blandishment, by the second petitioner. She is still untraceable despite best efforts put in by the informant to trace her out. Since, it is a case involving a minor, who is still untraceable, the matter requires thorough investigation. We do not find it a fit case to exercise our jurisdiction under Article 226 of the Constitution of India. The petition is dismissed. September 24, 2025 S.A.
