Order 01/05/2025
1. The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S, 2023 against the
order dated 28.02.2025 passed by learned Sessions Judge, Sawai Madhopur (Raj.) in connection with FIR No. 207/2023, registered at Police Station Soorwal, District Sawai Madhopur for the offences punishable under Sections 406, 415, 418, 420, 467, 471, 120-B & 468 of IPC, by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed.
2.
Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter.
Learned counsel argues that the incident has been said to be occurred on 14.01.2021 and the FIR was lodged after a delay of almost more than two years i.e., on 29.08.2023. Learned counsel
[2025:RJ-JP:18458] (2 of 3) [CRLMB-3315/2025] also argues that the allegation against the accused-applicant is that he deceived the complainant and took money from her by pretending to be able to secure her a government job. It is also submitted that the charges levelled against the accused- applicant are for the offences punishable under Sections 415, 418, 420, 406, 467, 468, 471 & 120-B of IPC. Learned counsel contends that the accused-applicant was arrested on 20.02.2025 and since then, he is behind the bars. Learned counsel prays that marriage of cousin brother of the accused-applicant is also scheduled to be held on 08.05.2025 and trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail.
3. On the other other hand, learned Public Prosecutor opposes the bail application.
4. Heard learned counsel for the parties and also perused the material available on record.
5. Having regard to the facts and circumstances of the case and considering the fact that charges levelled against the accused-applicant are triable by Judicial Magistrate and also considering the fact that charge-sheet has been filed and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused- applicant.
6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused- applicant-Radhey Son Of Lakhanlal, arrested in FIR
[2025:RJ-JP:18458] (3 of 3) [CRLMB-3315/2025] No.207/2023, registered at Police Station Soorwal, District Sawai Madhopur shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court.
