Also heard Mr. K Baishya, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 430 (2) of the BNSS, 2023 praying for suspension of sentence imposed upon the applicant vide judgment dated 19.04.2024 passed by the learned Sessions Judge, Udalguri in Sessions Case No. (II)15/2018 as well as for allowing him to go on bail. 3. I have considered the submissions made by the learned counsel of both sides. I have also gone through the impugned judgment. 4. This Court is of the opinion that at this stage, the prayer of the applicant deserves to be allowed. Therefore, the sentence imposed upon the applicant Md. Alal Uddin vide judgment dated 19.04.2024 passed by the learned Sessions Judge, Udalguri in Sessions Case No. (II)15/2018 shall remain suspended till disposal of the connected appeal. 5. The applicant, namely, Md. Alal Uddin shall be allowed to go on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Sessions Judge, Udalguri.
