This application has been filed under section 5 of the Limitation Act praying for condonation of 22 days of delay in preferring the connected appeal. Ms. S. Jahan, learned Addl. P.P. submits that she has no objection if the delay is condoned. We have considered the submission made by the learned counsel appearing for both side. We find that the delay has been satisfactorily explained. Moreover, going for issuing of notice upon the respondent No. 2 it would be nothing but waste of time. Therefore, the delay stands condoned.
