The petitioner has preferred the present writ petition with the prayer to direct the respondent no. 2 to compliance the allotment/selection of Fair Price Shop in favour of the petitioner which is pending since 25.09.2023. 2. The petitioner was selected as a fair price shop dealer against to cancellation of fair shop license of one Sri Surendra Kumar Yadav on 24.02.2023. 3. Pursuant to order passed by this Court a personal affidavit of Sub Divisional Magistrate, Tehsil Phulpur, District Prayagraj/Respondent no. 3, placed before this Court, the same is taken on record. 4. It is stated in paragraph no. 7 of the aforesaid affidavit that against the cancellation order dated 24.02.2023 Sri Surendra Kumar Yadava preferred an appeal before the Joint Food Commissioner, Prayagraj Division, Prayagraj being appeal no. 502/2023 which was allowed on 01.03.2025. Subsequent to the same an order dated 22.05.2025 passed by the answering respondent in favour of Sri Surendra Kumar Yadav. 5. After going through the same, a prayer has been made by learned counsel for the petitioner to dismiss the present petition as withdrawn with liberty to file fresh petition challenging the aforesaid orders, if so advised. 6. This prayer has not been opposed by learned counsel for the respondent. 7. Accordingly, the present petition is dismissed as withdrawn with liberty as prayed.
