This petition purportedly in public interest has been filed seeking removal of alleged illegal 'Gumtis' installed over the roads of Basti city creating nuisance and encroachment. 2. Submissions made in the petition indicate that the same essentially are not encroachments rather the allotment has been made by the Nagar Palika Parishad, Basti to the occupants. 3. In case the petitioner is aggrieved of the scheme of Nagar Palika Parishad and consequential allotments made to the occupants, he was required to implead all the allottees whose allotments are sought to be questioned by him by filing purported public interest litigation. 4. Besides the same, the petitioner apparently has not confined his petition to a particular road/area and a general prayer has been made for removal of 'Gumtis' across the city and, therefore, it would be incumbent on the petitioner to implead all the occupants before maintaining the petition. 5. In view thereof, the petition as filed by the petitioner cannot be entertained, the same is, therefore, dismissed, leaving it open for the petitioner to take appropriate measures in accordance with law.
