By virtue of order dated 4th June, 2026, we disposed of the writ petition, bearing WP (C) No. 2504/2026, making/issuing, among others, the following observation/direction in its paragraph 04: “4.We clarify that the petitioners shall not recover any alleged excess amount from the respondent which has already been received by him and further the petitioners shall be at liberty to pay retiral benefits to the respondent after deducting the benefit under SRO 59/1990. However, this direction shall remain subject to outcome of the OA.” 2. While having a glimpse of the order dated 4th June 2026 again, particularly paragraph 04 (supra), it has come to fore that due to oversight we have not made mention of “remitting the matter to the learned Tribunal”, albeit we mentioned in the said order that the “direction shall remain subject to outcome of the OA”. 2 WP ( C ) No. 1628/2025 c/w WP ( C ) No. 2504/2025 WP ( C) No. 69, 76,83 of 2026 WP ( C) No. 3219/2025 3. Accordingly, taking suo moto note as ingeminated above, we deem it proper to modify the order dated 4th June 2026, by adding the words that “The matter is remitted to the learned Tribunal”.
