JUSTICE SANDEEP KUMAR ORAL ORDER 3 19-04-2025 Heard learned counsel for the parties. Cr. Misc. No. 4488 of 2025 and Cr. Misc. 7392/2025 2. The petitioners seek regular bail in connection with Banmankhi P.S. Case No. 556 of 2023, registered for the offence under Section 394 of the Indian Penal Code and the charge-sheet has been submitted under section 395 of the Indian Penal Code. 3. One Anmol Kumar and other criminals looted the tractor loaded with fertilizers. During investigation, the name of the petitioners have come as having participated in the loot. The petitioner namely Sonu Kumar is in jail since 25.09.2024 and the petitioner namely Amarjeet Kumar @ Amarjeet Kumar Paswan is in jail since 06.05.2024. Though the tractor has been recovered but the fertilizers has not been recovered. 4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Petitioners are not named in the F.I.R. and their names surfaced in this case on the basis of confessional statement of co-accused Amit Yadav. 5. Learned A.P.P. for the State has opposed the prayer for bail. Patna High Court CR. MISC. No.4488 of 2025(3) dt.19-04-2025 3/4 6. Considering the serious nature of allegation, this Court is not inclined to grant bail to the petitioners. 7. Accordingly, the prayer for regular bail of the petitioners stands rejected. 8. The trial court is directed to expedite the trial and conclude the same at the earliest. Cr. Misc. No. 5524 of 2025 9. Heard learned counsel for the petitioner and learned A.P.P. for the State. 10. The petitioner seeks regular bail in connection with Banmankhi P.S. Case No. 556 of 2023, registered for the offence under Section 394 of the Indian Penal Code. 11. One Anmol Kumar and other criminals looted the tractor loaded with fertilizers. During investigation, it has come that other accused persons has kept the looted fertilizers on the darwaza of the petitioner when the petitioner was not present. 12. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. No incriminating material has been recovered from the petitioner. The petitioner is in jail since 31.10.2024 having clean antecedent. 13. Learned A.P.P. for the State has opposed the Patna High Court CR. MISC. No.4488 of 2025(3) dt.19-04-2025 4/4 prayer for bail. 14. Considering the facts and circumstances of the case and also period of custody, this bail application is allowed. 15. Let the petitioner above named, (Ranjeet Yadav @ Ranjit Kumar Yadav) be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea/concerned court in connection with Banmankhi P.S.
