(Hon’ble Shri Justice Naresh Kumar Chandravanshi) Order on Board 22-3-2025 1 The applicant has preferred this second application for grant of anticipatory bail under Section 482 of the Bhartiya Nagrik Suraksha Sanhuita, 2023 as he apprehend his arrest in connection with Crime No. 212/2020 registered at Police Station Baloda, Distt. Janjgir – Champa (CG) for the offence punishable under Section 420, 467, 468, 471, 34 of the IPC. His 1st application for anticipatory bail was rejected by this Court vide order dated 25-11-2021 passed in MCRCA No. 1225/2021 as withdrawn. 2 Allegation against the applicant is that the applicant was working as Office Assistant in CG State Gramin Bank, Branch Pantora, Distt. Digitally signed by AVANISH KUMAR PATHAK Date: 2025.03.24 17:07:27 +0530 2 Janjgir – Champa and he in collusion with other co-accused persons, by deceiving various villagers, obtained their signatures in blank withdrawal forms of the Bank in the garb of providing them loan and got withdrawn Rs. 46,000/- from 17 accounts of the villagers and thereby, they cheated villagers. Based on above facts, instant crime has been registered. 3 Learned counsel for the applicant submits that, applicant was on probation of his service at the time of incident. He was not well aware about procedure of the bank. Being Accountant, he gave money against withdrawal forms, which were approved by the Branch Manager of CG State Gramin Bank, Branch Pantora, Distt. Janjgir- Champa. All the villagers have received their amount which was withdrawn from their account and they have filed affidavits in this regard. Applicant has been falsely implicated in the case only because, being Accountant of the bank, he had paid amount against withdrawal forms, which were verified / approved by the Branch Manager, as such, the applicant’s conduct was bonafide, hence, he may be granted benefit of anticipatory bail. 4 On the other hand, learned State counsel opposes the application for grant of anticipatory bail to the applicant. 5 I have heard learned counsel for the parties and perused the material available on record. 6 Having considered the fact and circumstances of the case, the allegation levelled against the applicant in the instant case, the victims have received amount, and considering totality of the facts, I feel inclined to grant anticipatory bail to the applicant. 3 7 Accordingly, the anticipatory bail application is allowed and it is directed that in the event of arrest of the applicant in connection with the aforesaid offence, he shall be released on bail by the officer arresting him on his executing a personal bond in a sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the officer arresting him or the concerned investigating officer. The applicant shall also abide by the following conditions:- (i) that he shall make himself available for interrogation before the investigating officer as and when required; (ii) that he shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or any police officer. (iii) that he shall not act in any manner which will be prejudicial to fair and expeditious trial; and (iv) that he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial; (v) that in case of change of address he will inform new address to investigating agency.
