The present writ petition has been filed for issuance of direction upon the respondent no. 2 – the Deputy Commissioner, Hazaribagh to renew and execute Khas Mahal Lease in favour of the petitioner pursuant to Lease Renewal Case No. 62/2007-08 for the period 01.04.2008 to 31.03.2038 appertaining to Plot Nos. 278, 280, 281, 282, 283, 266, 268, 265 & 279 in B.L. Holding No. 77, Village-Sarley, Canary Hill Road, Hazaribagh, measuring an area of 2.79 acres. 3. Learned counsel for the petitioner submits that though the Divisional Commissioner has recommended for renewal of lease, yet the respondent no. 2 has not passed any order and the application is pending since 2011. 4. Learned counsel for the State submits that the 2025:JHHC:20724 2 petitioner may file fresh representation before the respondent no. 2 who will look into the matter. 5. Learned counsel for the respondent no. 5 submits that the said respondent should also be provided an opportunity of hearing by the respondent no. 2 while considering the petitioner’s representation for renewal of Khas Mahal Lease of the land in question. 6. Considering the submission of learned counsel for the parties, the petitioner is given liberty to file a fresh representation before the respondent no. 2 seeking renewal of Khas Mahal Lease. On receipt of the said representation, the respondent no. 2 shall take appropriate decision in accordance with law after providing an opportunity of hearing to the petitioner as well as the respondent no. 5 as expeditiously as possible preferably within 12 weeks from the date of filing of the representation. 7.
