Sri Bhanu Prakash Verma, learned counsel for the applicant and Sri Alok Mishra, learned A.G.A. for the State are present. The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 25.08.2025 passed by Additional Sessions Judge/ Special Judge (POCSO Act), Court No. 2 Mathura, in Criminal Revision No. 30 of 2025, whereby the revisional court affirmed the order dated 24.08.2023 passed in Complaint Case No. 23011 of 2023, by which the learned Magistrate took cognizance under Sections 323, 504, 506, 452 of I.P.C., Police Station- Highway, District Mathura, pending in the court of Additional Civil Judge (Junior Division)/ Judicial Magistrate, Court No. 12, Mathura. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
