1. By the present writ petition, the petitioner is questioning the order dated 13.09.2023 by which the revision filed by the petitioner under Section 50 before the Board of Revenue has been dismissed for want of prosecution.
2. Learned State counsel has raised the objection that petitioner without approaching the Board of Revenue by filing an application for restoration of the revision, he has preferred the present writ petition and the writ petition is not maintainable.
3. I have perused the order dated 13.09.2023 which has been dismissed by the Board of Revenue because of absence of the petitioner as well as his counsel before the Board of Revenue to prossecute the revision.
4. The writ petition is disposed of with a liberty to the petitioner to approach the Board of Revenue by filing an application for restoration of the revision, in case, any application filed before the Board of Revenue, the same shall be considered in accordance with law.
5. With the aforesaid liberty, the writ petition is disposed of. Sd/-
