PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A4, seeking bail, in Crime No.232/2024 of Visakhapatnam GRP Vijayawada. 2. A case has been registered against the petitioner/A4 and others for the offence punishable u/Sec.20(b)(ii)(B) r/w 8(c) of NDPS Act. 3. Heard learned counsel for the petitioner/A4 and the learned Assistant Public Prosecutor representing the respondent/State. 4. Case of the prosecution, in brief, is that, on 22.7.2024 in between 10.00am to 12.30pm, on receipt of credible information regarding illegal possession and transportation of ganja, the S.I of Police, GRP Visakhapatnam, along with staff and mediators went to gate no.4 of plat form no.8 of Visakhapatnam Railway Station and noticed two persons in 2 suspicious circumstances. On seeing police, they tried to escape. Then police apprehended them and on enquiry, they disclosed their identity particulars as that of A1 and A2 and police found 10 kgs of ganja in their possession. Police seized the contraband, arrested the accused. On their confession, during the course of investigation, police arrested A4 on 02.3.2025 and remanded him to judicial custody. 5. Heard. Perused the record. 6. Learned Assistant Public Prosecutor submits that the petitioner filed bail application before the Sessions Court on 03.3.2025 and it was dismissed on 12.3.2025. Whereas the present application was filed on 04.3.2025 i.e. one day after filing the bail application before the Court of Sessions, and requested the Court to pass appropriate orders. 7. It seems that during the pendency of the application for bail before the Court of Sessions, this application was filed before this Court. In view of the filing two bail applications at the same time, this Court is not inclined to exercise its discretion. 8.
