…...... 11 / 15.01.2025: In this writ petition, the petitioner has prayed for a direction upon the respondents to pay him the scale of Public Prosecutor as he was given the charge for the Public Prosecutor for one and half months.
2. Admittedly, the petitioner is an Assistant Public Prosecutor and was appointed in terms of Section 25 of the Code of Criminal Procedure,
1973. As there was no Public Prosecutor, vide Annexure-1 in terms of Sections 24 and 25 of the Code of Criminal Procedure, 1973, he was given charge of Public Prosecutor, vide Notification dated 22nd June, 2007. He started working from 23rd June 2007 and ultimately superannuated on 31st July, 2007.
3. Admittedly, the petitioner was not promoted to the post of Public Prosecutor and his substantive post remained that of the Assistant Public Prosecutor. Since, the petitioner has not been promoted on regular basis to the post of Public Prosecutor, he is not entitled for the pay scale attached to the post of Public Prosecutor, as claimed by him, I find no merit in this writ petition, the same is accordingly dismissed.
