HON'BLE KUNAL RAVI SINGH, J.
1. Heard Shri K.K. Chaurasia, learned counsel for the petitioner; Shri Devesh Vikram, learned Addl. Chief Standing Counsel for State respondents and Shri Vibhu Rai, learned counsel for Prayagraj Development Authority (in short "PDA").
2. The instant writ petition has been preferred for quashing the mutation proceeding initiated by respondent no.3 by way of application dated 16.4.2025 pending before respondent no.2-Vice Chairman, PDA till disposal of Original Suit No.1051 of 2024 (Shish Khan v. Salman Khan) pending before Civil Judge (JD), Garvi, Allahabad. It is further prayed for a direction to respondent no.2 not to mutate the name of respondent no.3 in the revenue record till the disposal of present writ petition.
3. At the very outset, learned counsel for respondents has raised an objection qua the maintainability of the writ petition on the ground that dispute is purely between the private parties for which aforesaid suit proceeding is still going on. Highly disputed facts have been raised, which cannot ordinarily be adjudicated under Art.226 of the Constitution of India, as such the writ petition is liable to be dismissed.
4. Confronted with this, learned counsel for the petitioner submits that he is not inclined to press the writ petition. However, leave may be accorded to the petitioner to press the relief in the ongoing suit proceeding before the competent civil court.
