This writ petition has been filed for following relief: "It is therefore most respectfully prayed that this Hon'ble court may be pleased to allow the petition and direct the trial court to decide the Suit No. 1066 of 2010 (Sreemanta Kundu Versus Jayant Kundu and another) pending before Civil Judge (S.D.), F.T.C. Varanasi, expeditiously preferably within a period of six month on day to day basis, and to pass such other and further order protecting the interest of the petitioner, so that justice may be done." 3. From the perusal of writ petition it is apparent that earlier also a petition being Matter under Article 227 No. 5553 of 2023 was filed by the petitioner for the same relief which was disposed of by order dated 15.05.2023. 4. In view of the Rule 7 of Chapter XXII of the Rules of the High Court Rules, 1952, second writ petition for the same relief, is not maintainable. 5. Accordingly, the writ petition is dismissed.
