HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22943 of 2025 Court No. - 47 HON'BLE RAJEEV MISRA, J. HON'BLE DR. AJAY KUMAR-II, J. Heard Mr. Jitendra Kumar Yadav, the learned counsel for petitioners and the learned A.G.A. representing respondents 1 and 2. Perused the record. Present writ petition under Article 226 of the Constitution of India has been filed challenging the F.I.R. dated 6.8.2025 registered as Case Crime No. 0344 of 2025, under Sections 191 (2), 191 (3), 190, 109, 131, 115 (2), 352, 351 (3) of the B.N.S. 2023, Police Station Jalesar, District Etah. On the matter being taken up, the learned A.G.A. representing State respondents 1 and 2. submits that Investigating Officer upon completion of statutory investigation of concerned Case Crime Number has already submitted charge sheet/police report dated 28.8.2025 in terms of Section 193 B.N.S. In view of above, he, therefore, submits that the present writ petition has now been rendered infructuous. When confronted with above, the learned counsel for petitioners could not overcome the same. Having heard the learned counsel for petitioners, the learned A.G.A. for State respondents 1 and 2 and upon perusal of record, we find that since the Investigating Officer has already submitted charge sheet/police report in terms of Section 193 B.N.S., no cause of action now survives with the Versus Counsel for Petitioner(s) : Aditya Singh, Jitendra Kumar Yadav Counsel for Respondent(s) : G.A. Pravesh Yadav And 9 Others .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) petitioner to press the present writ petition.
