(Oral) The applicant seeks anticipatory bail in FIR No.519 of 2024, dated 08.12.2023, under Sections 420 and 506 IPC, Police Station Ramnagar, District Nainital. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the applicant would submit that the co-accused having similar role has already been granted anticipatory bail. 4. Learned State Counsel would submit that as per instructions, investigation is pending and the Investigating Officer does not intend to arrest the applicant; he has served a notice, under Section 41-A of the Code of Criminal Procedure, 1973 to the applicant. 5. Since the Investigating Officer does not propose to arrest the applicant, the applicant has no apprehension of arrest. 2 Therefore, in such situation, anticipatory bail application may not be entertained. It stands disposed of accordingly.
