Udayakumar Government Advocate Criminal side ORDER This petition has been filed to enlarge the petitioner on bail, pending investigation in Crime No.185 of 2025, on the file of the Inspector of Police, C3 Seven Wells Police Station, Chennai. 2. On 08.07.2025, one Vala gave a complaint before the respondent police stating that one male body was found in the Coovam River. Based on that complaint, on investigation, the respondent police found that the deceased name is Srinivasalu and petitioner along with other accused have murdered him at Andhra Pradesh, transported the body from Andhra Pradesh to Chennai thrown in Coovam River. Initially the case has been registered under Section 103(1) of BNS and thereafter it was altered into Section 54, 55, 103(2), 115(2), 127(4), 351(2), 138, 77, 61(1)(a ), 238, 190 of BNS r/w 66 E of Information Technology https://www.mhc.tn.gov.in/judis CRL OP No. 24967 of 2025 Act. 3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Hence, he prays to grant bail to the petitioner. 4. The learned Government Advocate submits that Chandrababu Kotta/petitioner and Vinutha Kotta both are husband and wife, the deceased Srinivasalu is a helper in their house for past 7 years. Vinutha Kotta is a active member in Andhra pradesh Janasena Party. At that time members in Telugu Desam Party had arranged the deceased to spy Vinutha Kotta house. Thereafter, they came to know that and attacked him. Further, the deceased filmed Vinutha Kotta while she was changing her dress, upon discovering this other accused tracked down the deceased and confined him, ultimately tying a chain around his neck, causing his death. Immediately they transported the body through car and disposed the body in Basin Bridge river. Now, the investigation is completed and they respondent police proposed to transfer the investigation to Andhra pradesh. Hence, the petitioner murdered the deceased with previous motive and A6 father of A3 is still absconding and A3 released on bail. Considering the fact that the respondent police collected CCTV footage and other relevant materials so there is no possibility for tamper the evidence. Further, respondent police proposed to transfer the investigation to Andhra Pradesh. Hence, this Court is inclined to grant bail to the petitioner with conditions. 6. The petitioner directed to deposit a sum of Rs.2 lakhs incrmie No. 185 of 2025, on such deposit, the petitioner is ordered to be released on bail on executing separate bonds for a sum of Rs.30,000/- (Rupees Thirty Thousand only) with two sureties, in which one surety must be a blood surety for a like sum to the satisfaction of the VIII, Metropolitan,Magistrate, George Town, chennai, and on further conditions that:: (a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; https://www.mhc.tn.gov.in/judis CRL OP No. 24967 of 2025 (b) the petitioner shall report before the respondent police daily at 10.30 a.m. Till tranfer of investigation to Andhra Pradesh. Thereafter, shall appear before the investigating agency at Andhra Pradesh. (c) the petitioner shall not tamper with evidence or witness either during investigation or trial; (d) the petitioner shall not abscond either during investigation or trial; (e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (f) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
