The instant writ petition has been filed for following relief: 1. Issue a direction Under Article 227 directing the learned direct the learned Addl. District and Sessions Judge/FTC-IInd, Hapur to expedite and decide the Civil Appeal No. 160/2018 (Bhagat Singh Vs. Vinod Kumar) pending before him within time fixed by this Hon'ble Court. II. Issue a writ under Article 227 of Constitution of India directing the learned Civil Judge (Sr. Div.)-IInd, Hapur not to implement the judgment and decree dated 19.11.18/01.12.2018 passed by Civil Judge (Sr.Div.)- IInd, Hapur passed in Original Suit No. 75/2015 (Vinod Kumar Vs. Bhagat Singh). 3. Contention of the learned counsel for the petitioner is that the aforementioned appeal is pending since 2018 for adjudication. He prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the Addl. District and Sessions Judge/FTC-IInd, Hapur to consider and decide the aforementioned appeal of the petitioner, in accordance with law, expeditiously, preferably within a period of one year from the date of production of a certified copy of this order after ensuring service upon all the Versus Counsel for Petitioner(s) : Kanjaanan Pyare Singh, Saurabh Chaudhary Counsel for Respondent(s) : Bhagat Singh .....Petitioner(s) Vinod Kumar .....Respondent(s) respondents, after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
