This is an application under Section 151 CPC for revival of the revision petition. 2. For the reasons mentioned in the application, which is duly supported by an affidavit, the same is allowed. It is further jointly submitted that Civil Suit No.301 of 2017 titled as “Babu Ram Vs. Manohar Lal and others' is also pending for 02.07.2025 but the same is pending before another Court, which is of Sh. Mohammad Sageer, Additional Civil Judge (Senior Division), Rohtak. It is stated that in both the cases, one of the properties is the same and all the parties except one are also the same and it is jointly prayed that both the cases be heard and decided by one Court in order to avoid conflicting judgments. 2. Keeping in view the above-said facts and circumstances and on account of the consent between both the parties, the present petition is disposed of by upholding the impugned order dated 12.07.2024 (Annexure P-1), with the following observations/directions:- (i) The petitioner as well as contesting respondent No.1 would jointly move an application before the learned District Judge for listing both the cases i.e. Civil Suit No.121 of 2016 titled as “Manohar Lal Vs. Sahil etc.” and Civil Suit No.301 of 2017 titled as “Babu Ram Vs. Manohar Lal and others” before one Court. (ii) On the said application being made, the District Judge would order the listing of both the cases before one Court having the jurisdiction to try the cases.
